Berths in Westhaven (Existing Marina) Trust area moving to full rental occupancy model in 2026

Auckland Council has announced that all berths currently in the Westhaven (Existing Marina) Trust area will move to a full rental occupancy model after the expiration of licences associated with those berths on 29 September 2026.

Current berth licence holders will be offered the opportunity to sign a new berth rental agreement well in advance of the expiration date. These agreements will be effective from 30 September 2026, ensuring continued access to berths for those marina customers.

The bulk of the marina’s berths consist of a rental pool and privately licenced berths which are currently held in two trusts, the “Existing Marina” and “Marina Extension” trusts. Westhaven also has additional berths at Z-Pier, and pile moorings, neither of which are included in the trusts.

The Existing Marina area includes berths from AB pier to the western side of T pier, while the Marina Extension area includes berths from the eastern side of T pier to Y pier.  A map showing the different areas of the marina is available here.

All berth licences within the Existing Marina trust expire on 29 September 2026. The trust, and all berth entitlement units (BEUs) issued in relation to the trust, terminate on 30 September 2026. At that time, all residual rights and assets comprising the Existing Marina revert to Auckland Council ownership and control.

Current rental customers with berths in the Existing Marina will continue to be able to rent berths under the new full rental occupancy model but will transition onto a new, updated rental agreement. Berth licence holders in the Westhaven (Marina Extension) Trust, and berths at Z-Pier are unaffected by this change.


Westhaven (Marina Extension) Trust
The change to full rental occupancy applies only to berths in the Existing Marina trust area at this stage. There is a separate and later expiry date for the berth licences held in the Marina Extension trust, which means they continue unaffected. Those berth licences and BEUs, and the Westhaven (Marina Extension) Trust, do not expire until April 2029. There will be separate communication to berth licence holders in the Marina Extension trust well in advance of that expiration date.


Next steps
Berth licence holders in the Existing Marina do not need to do anything immediately, and the marina will continue to operate as normal over summer. All licences remain valid until their expiration date. Existing Marina customers will be contacted again early in 2026 with more information as the new rental agreements will be rolled out over a period of months to berth licence holders and rental customers.

 

Questions and answers

Why are things changing?
The trust structure currently in place at Westhaven Marina is reaching the end of its term. The trust for the Existing Marina will expire first, on 30 September 2026. The trust for the Extension Marina will expire later, in April 2029. When each of those trusts expire, all of the berth licences in those parts of the Marina will also expire.

 

How will this change impact berths in the different parts of the marina?
Existing Marina: All berths in the Existing Marina will move to a full berth rental occupancy model on 30 September 2026. All current berth licence holders in the Existing Marina will be offered a new rental agreement to secure a berth well in advance of the expiration date.

For rental customers in the Existing Marina, the only change will be the introduction of a new, updated rental agreement.

The team will also use the opportunity to review boat and berth sizes to ensure they align. Some customers may be asked to move their boats to berths of appropriate size.

Marina Extension: No impact at this time. The berth licences and BEUs for berths in the Marina Extension area do not expire until 3 April 2029, and remain valid. There will be separate communication with berth holders in the Marina Extension well in advance of that expiry date to discuss the future of those berths.

Z-Pier: No impact. Z-Pier is not part of the trusts.

Pile moorings: No impact. The pile moorings are not part of the trusts.

 

When will I be contacted about the new rental agreement and when will they be available?
Berth holders in the Existing Marina will be contacted early in 2026 with next steps on the roll-out of the new rental agreements, which will happen over a period of months, given the large number of berths involved.

Is anything changing with day-to-day operations at the marina?
No. The marina team that you know and trust will continue to manage day-to-day operations. The marina will also continue to operate as normal over summer and as the new rental agreements are rolled out to customers.
